KANSAS LEGISLATURE PASSES BI-PARTISAN  

CITIZEN ONLY VOTING AMENDMENT 

KS, SD LEAD NATION IN PROTECTING CITIZEN ONLY VOTING

 TOPEKA, KS – The Kansas Senate passed the Citizen Only Voting Amendment (HCR5004) today in a bi-partisan vote (37-3) that placed the constitutional amendment on the 2026 general election ballot. The resolution had passed the House of Representatives by a bi-partisan vote (90-28) on February 5.  

“I am honored to have been a small part of this nationwide effort to declare with one voice that citizenship still means something in this country, that the vote should be reserved only to US citizens,” said the resolutions’s author Representative Pat Procter. 

Kansas joins South Dakota in passing a Citizen Only Voting Amendment this legislative session. Citizen Only Voting Amendments are currently working through the legislative process in Alaska, Arkansas, Mississippi, Montana, Maine, Nebraska, New Hampshire, New Jersey, New York, Texas, and West Virginia.  

“HCR 5004 is a straightforward constitutional amendment to ensure only American citizens can vote,” said Senate President Ty Masterson. “Kansans will be able to make it clear that they support safeguarding the integrity of our elections.” 

“We are excited about the bi-partisan support for Citizen Only Voting in Kansas,” said Americans for Citizen Voting  

President Avi McCullah. “According to our polling, people of every party, ideology, race, and gender believe that citizenship should be a requirement for voting.” 

In recent years city councils in Washington, DC, Vermont, and Maryland have voted to legalize foreign citizen voting in local elections. They joined cities in California, Illinois, and Maryland which, because of a loophole in their state constitutions, allow foreign citizen voting. 

“Though our political climate can be very polarizing,” continued McCullah, “We have seen that Citizen Only Voting is an issue that crosses party lines and transcends ideology.” 

Americans for Citizen Voting is a nonpartisan grassroots organization dedicated to helping citizens pass Citizen Only Voting Amendments. In recent years, these 14 states have passed COVA: Alabama, Colorado, Florida, Idaho, Iowa,  Kentucky, Louisiana, Missouri, North Carolina, Ohio, Oklahoma, North Dakota, South Carolina, and Wisconsin. COVA efforts are underway in Arkansas, Indiana, Kansas, Mississippi, Montana, Nebraska, Texas, and West Virginia.
